1. A-TEAM SOLUTIONS STAFF (PRIOR TO ASSIGMENT) INTERNAL ORIENTATION
a. A-TEAM SOLUTIONS shall provide basic orientation to staff on A-TEAM SOLUTIONS’s own internal clinical and environmental life safety policies and practices.
b. A-TEAM SOLUTIONS shall ensure that their personnel complete any Participating Institution (facility)-specific orientation submitted in writing in advance, as required below, as a condition to placement of A-TEAM SOLUTIONS personnel with Participating Institution.
c. A-TEAM SOLUTIONS warrants compliance with all State, Federal, CDC, OSHA, The Joint Commission (TJC) Healthcare Staffing Services (HCSS) Standards, TJC Core Measures and appropriate CMS, Conditions of Participations (CoPs), Ethics, Social Media Restrictions, Security of Patient Rights and Privacy (HIPAA) and other Federal regulations for all A-TEAM SOLUTIONS personnel. Participating Institution will provide A-TEAM SOLUTIONS with any necessary documents pertaining to Participating Institution-specific orientation and this information will be reviewed with A-TEAM SOLUTIONS personnel at A-TEAM SOLUTIONS’s office.
2. PARTICIPATING INSTITUTION’s (PRIOR TO ASSIGNMENT) ORIENTATION RESPONSIBILITIES
a. PRIOR to the A-TEAM SOLUTIONS’s staff assignment begins, the Participating Institution shall
i. Unit Orientation and Validation. Provide orientation to the unit to which A-TEAM SOLUTIONS personnel will be assigned.
ii. Float Unit Orientation and Validation. When asked to float to another unit the Participating Facility will provide and validate orientation to the unit
iii. Annual A-TEAM SOLUTIONS orientation and competency testing, will be done by the A-TEAM SOLUTIONS as well as the Participating Institution
b. Participating Institution shall notify A-TEAM SOLUTIONS and shall be responsible for scheduling and verifying the orientation of A-TEAM SOLUTIONS personnel, at a Participating Institution, before such A-TEAM SOLUTIONS personnel’s assignment to specific unit, at that Participating Institution.
c. Participating Institutions shall be responsible for making orientation sessions available to A-TEAM SOLUTIONS personnel before such individual’s assignment. Before an assignment begins, the Participating Institution shall provide orientation to the unit to which A-TEAM SOLUTIONS personnel will be assigned and validate orientation to the unit when asked to float to another unit. A-TEAM SOLUTIONS staff will receive annual A-TEAM SOLUTIONS orientation and competency testing, as well as those of facility.
3. PARTICIPATING INSTITUTION’s (PRIOR TO ASSIGNMENT) A-TEAM SOLUTIONS STAFF EDUCATION AND COMPETENCY TESTING
a. PRIOR TO A-TEAM SOLUTIONS staff being assigned to a Participating Institution the following requirements must be met.
i. Orientation Program. A-TEAM SOLUTIONS shall request from, review, and educate staff on the details of the Participating Institution’s Orientation Program.
ii. Standards of Performance. A-TEAM SOLUTIONS staff are given a copy of, educated and knowledgeable of the Participating Institution’s expected Standards of Performance.
iii. Clinical Area “Prioritized” Specific Competency Testing. A-TEAM SOLUTIONS staff will have completed and passed the “prioritized specific” and general competencies requirements for the areas, which they are assigned.
iv. Life Safety and Infection Control Education
1. A-TEAM SOLUTIONS staff will be educated on
a. National Patient Safety Goals
b. Disaster and Emergency preparation and Testing
c. Use of personal protective equipment related to potential infectious diseases (such as COVID), unit
d. Hospital specific protocols (including medications) and specific life safety requirements by facility.
4. MUTUAL A-TEAM SOLUTIONS AND PARTICIPATING INSTITUTION EDUCATION
a. Both A-TEAM SOLUTIONS and Participating Institution shall educate staff on programs, actions, training, etc. designed to meet National Patient Safety Goals and Performance Improvement Measures, CDC, OSHA, CMS, OIG, TJC, and other official agencies.
5. A-TEAM SOLUTIONS RESPONSIBILITIES
a. A-TEAM SOLUTIONS Staff Assignment
i. Fully Qualified. A-TEAM SOLUTIONS shall not offer or assign A-TEAM SOLUTIONS personnel to a Participating Institution unless the A-TEAM SOLUTIONS has determined that the individual is fully qualified for the assignment and can provide safe and effective patient care services.
b. TJC HCSS Certification Verification
i. A-TEAM SOLUTIONS shall provide proof of The Joint Commission (TJC) Healthcare Staffing Services (HCSS) Certification compliance to the Participating Institution upon request or initial placement of A-TEAM SOLUTIONS staff and when Participating Institution is being surveyed by State, Federal agencies, CMS, or TJC.
c. Annual Participating Institution and Staff Performance and Competency Evaluations. (for thirteen-week assignments)
i. A-TEAM SOLUTIONS shall provide evaluations at least annually and facility competency and performance and competencies of A-TEAM SOLUTIONS personnel placed at facility. In compliance with The Joint Commission (TJC) Healthcare Staffing Services (HCSS) Certification Standards for both A-TEAM SOLUTIONS (TJC) the evaluations are conducted for thirteen-week assignments. Feedback to both A-TEAM SOLUTIONS and personnel is encouraged at intervals to improve patient care and safe practices. If facility agrees with the evaluation, no further actions are required. Facility is encouraged to review and add comments to evaluation and return to A-TEAM SOLUTIONS within 10 days.
ii. The evaluations will provide verification by statement and a signed copy of performance evaluation/competencies that A-TEAM SOLUTIONS personnel were provided at the time of initial placement and at each evaluation period.
6. PARTICIPATING INSTITUTION IMMEDIATE NOTIFICATION OF EMERGENT SENTINEL, PATIENT ENDANGERMENT. SAFETY, AND PERSONNEL PERFORMANCE EVENTS AND RELATED EVENTS.
a. Participating Institution shall notify A-TEAM SOLUTIONS immediately of any incidents, errors, sentinel events, injuries, unanticipated deaths or safety hazards, ethical issues/concerns, cultural issues/concerns, complaints, grievances, absenteeism, tardiness, failure to perform duties at expected levels, property damage or negative pattern or trend or any other adverse event not otherwise included, or in violation of local, state, and federal laws.
b. Each of the above may be reported by telephone but must be submitted either by email or letter to allow A-TEAM SOLUTIONS sufficient information to work with A-TEAM SOLUTIONS personnel and Participating Institution to clarify, arbitrate, resolve, or implement disciplinary actions when/where appropriate.
c. A-TEAM SOLUTIONS will be included in review and/or actions for any of the above. Facility shall not discriminate but treat A-TEAM SOLUTIONS staff in accordance with policies for facility’s employees related to disciplinary actions.
7. PARTICIPATING INSTITUTION, A-TEAM SOLUTIONS STAFF PARTICIPATON IN CLINICAL AND ENVIRONMENT OF CARE CLASSES AND MEETINGS.
a. Participation by A-TEAM SOLUTIONS staff assists the Participating Institution and A-TEAM SOLUTIONS to comply with safe patient practices, regulations of OIG, CMS, and standards of The Joint Commission for both Hospital Accreditation Program (HAP) and TJC HCSS Certification program.
b. Participating Institution shall include A-TEAM SOLUTIONS personnel in staff meetings, safety training programs, to include, but not be limited to, fire, emergency, disaster, etc., in addition, CPR classes if offered prior to their expiration of current card. (Extension of 30-60 days to complete classes allowed in jurisdictions with those rules)
8. ASSIGNMENT
a. Neither party may assign this Agreement without the prior written consent of the other party, nor will such consent not be unreasonably withheld. No such consent will be required for assignment to an entity owned by or under common control with assignor, as this is a “Due Diligence Document” in compliance with TJC. In any event, the assigning party will remain fully responsible for compliance with all of the terms of this agreement.
9. USE OF SUBCONTRACTORS/INDEPENDENT CONTRACTOR
a. Use of Subcontractors/Independent Contractors. If the A-TEAM SOLUTIONS uses a subcontractor/independent contractor to provide services to Company, A-TEAM SOLUTIONS will require conditions to the subcontractor/independent and its employees, if any, as outlined in this agreement. A-TEAM SOLUTIONS will evaluate services of the subcontractor/independent on an ongoing basis.
10. INSURANCE
a. General Liability Insurance as required by law and presented to facility with contract.
11. NO FINANCIAL INTEREST
a. Officials of Health Care Staffing A-TEAM SOLUTIONS, do not have a financial interest or other relationship
with the facility in which they place staffing personnel.
12. CALIFORIA NURSES PATIENT RATION
a. Nurses assigned to work in California will not accept a patient assignment above the nurse patient ration adopted by the California Office of Administrative Law (OAL), AB 394, of September 2003. They shall likewise adhere to staffing standards as written into law in other states.
13. A-TEAM SOLUTIONS STAFF IDENTIFICATION
a. A-TEAM SOLUTIONS staff will provide picture identification to the facility on the first day of work. The identification must be company or government issued.
14. A-TEAM SOLUTIONS STAFF REPORTING
a. A-TEAM SOLUTIONS staff may report issues from facility or A-TEAM SOLUTIONS directly to the The Joint Commission, or CMS, without fear of retribution.
